Refund Policy

This Refund Policy explains when you are entitled to cancel a purchase and when you are entitled to a refund. It is written to comply with:
- the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCR 2013") — the UK implementation of the Consumer Rights Directive;
- the Consumer Rights Act 2015 ("CRA 2015") — statutory quality standards for digital content;
- the EU Consumer Rights Directive 2011/83/EU, as amended by Directive (EU) 2019/2161, for EU-resident consumers;
- the card-scheme rules of Visa and Mastercard and the operating rules of our payment processor, CCBill.
This Refund Policy is part of the Terms of Service. Where there is any inconsistency, the provisions of the Terms of Service and of the applicable statute prevail.
1. What you are buying
Galerie Minuit offers paid subscription tiers that give access to additional features of an adult social networking and dating platform. What you are buying is access to digital content and digital services supplied over a subscription period — typically monthly or annual.
You are not buying:
- physical goods;
- services provided by other members;
- any guaranteed outcome (matches, dates, meetings); or
- the conduct of other members.
All purchases are processed by CCBill (CWIE, LLC), a PCI-DSS compliant third-party payment processor. Your billing descriptor on your card or bank statement will show CCBill or a related descriptor approved by the card schemes.
2. Your statutory right to cancel (the 14-day "cooling-off" period)
Under CCR 2013 reg. 29 (and the equivalent EU law), when you buy a subscription online you have a 14-day right to cancel from the day the contract is concluded. During this period you can cancel for any reason, without charge.
2.1 How the waiver works for digital content
Because our services supply digital content and digital services immediately — you get access the moment your first payment clears — CCR 2013 reg. 37(1) and reg. 36(1)(a) apply:
- the 14-day cancellation right is lost once supply has begun, provided that before supply began you gave us your express consent to immediate performance and you acknowledged that the right to cancel will be lost;
- if supply has begun but has not yet completed when you notify us that you wish to cancel within the 14-day window, you may still cancel and we will refund you for the part of the period that had not yet been performed, unless you had given the express consent + acknowledgement described above.
We ask for this express consent and acknowledgement at checkout. If you do not give it, supply does not begin until the 14-day period expires — and you lose no statutory rights.
2.2 How to cancel during the 14-day period
If you are within your 14-day cooling-off period you may cancel in any of these ways:
- in Settings → Subscription → Cancel;
- by emailing billing@galerieminuit.com with "Cancel — cooling off" in the subject;
- by completing the Model Cancellation Form reproduced at the end of this policy, and sending it by email or post to [LEGAL ENTITY], [REGISTERED OFFICE ADDRESS];
- by contacting CCBill Consumer Support at ccbill.com/consumer-support.
The cancellation takes effect the moment you send us a clear statement of your decision to cancel.
2.3 What we refund
If your 14-day statutory cancellation right has not been waived (see 2.1):
- we refund 100% of any amount you have paid for the subscription period, using the same payment method you used to pay;
- we do this within 14 days of being told you are cancelling, as required by CCR 2013 reg. 34(1);
- if you have used the service before cancelling, we may deduct a proportionate amount corresponding to the service you received — CCR 2013 reg. 36(4).
If your 14-day statutory cancellation right has been waived (see 2.1 — i.e. you expressly consented to immediate supply and acknowledged the loss of the right), you have no statutory right to a refund for the remainder of the cooling-off period. You may still cancel ongoing renewals under Section 3.
3. Cancelling an ongoing subscription outside the 14-day window
You can cancel a subscription at any time.
- Go to Settings → Subscription → Cancel, or email billing@galerieminuit.com.
- Cancellation stops the next renewal.
- Your paid-for access continues to the end of the current billing period — you do not lose paid-for access on the day you cancel. We believe this is the fair balance.
- There is no pro-rata refund of the current period's fee when you cancel voluntarily outside the 14-day window. This is because you continue to have the benefit of the service until the end of the period. If you believe your circumstances merit an exception — for example, a serious health issue or a material change to the service on our side — write to us at the Billing address below and we will consider it.
4. Automatic renewal
Subscriptions renew automatically on the billing cycle you selected (monthly or annually) at the price in force at the time of renewal. We send a renewal reminder email before each renewal. You can turn off auto-renewal at any time in Settings → Subscription.
If we change the price, we will notify you by email and in-app at least 30 days before the change takes effect, and you will have the opportunity to cancel before the new price applies.
5. Refunds on our initiative — service failures
We will issue a refund in the following cases without requiring you to ask:
- We materially change the paid features you signed up for, and you object within 30 days.
- The service is unavailable for an extended outage that materially affects the value of your subscription (measured against our uptime commitments).
- We terminate your account for a reason that is not attributable to a breach of the Terms of Service or Acceptable Use Policy by you.
In each case we refund the unused portion of the current billing period, or a larger amount where fairness requires.
6. No refunds for breach of Terms or AUP
If your account is terminated because of a breach of the Terms of Service or Acceptable Use Policy — for example, sharing CSAM, harassment, fraud, commercial solicitation — you are not entitled to a refund. The subscription fee is retained. This is consistent with industry practice for adult-content platforms and with the processor's requirements.
7. Billing errors, duplicates, and fraud
Regardless of anything else in this policy, we refund in full and promptly where:
- you were charged in error (e.g. after a confirmed cancellation);
- you were charged twice for the same subscription period;
- an unauthorised person used your payment method to subscribe;
- a currency conversion or tax error resulted in you being over-charged.
Tell us at billing@galerieminuit.com within 90 days of the charge and we will investigate. Confirmed billing errors are refunded within 10 working days. If fraud is suspected, we will also help you contact CCBill and your card issuer.
8. Please contact us before filing a chargeback
A chargeback — disputing a charge through your card issuer — should be the last resort, not the first. Our own dispute process is usually faster, does not cost you any admin effort, and does not risk your account.
Filing a chargeback without contacting us first:
- does not speed up a refund — chargebacks typically take 30–90 days, where our direct refund takes 10 working days;
- may result in your account being suspended or terminated while the dispute is open, because the processor's rules require us to suspend service pending outcome;
- may affect your ability to subscribe to other services processed by CCBill;
- is recorded in the card-scheme dispute network and can affect your own chargeback ratio.
If you have already filed a chargeback, write to us anyway at billing@galerieminuit.com. We will work with you and CCBill to resolve it.
9. Consumer Rights Act 2015 — quality standards
Under CRA 2015 the digital content and digital services we supply must be:
- of satisfactory quality;
- fit for any particular purpose you told us about and relied on us for; and
- as described.
If the service does not meet those standards, you are entitled to a repair or replacement (for example, bug-fix, access restoration) and if that is not possible or is disproportionate, a price reduction or, in serious cases, the right to reject and receive a refund. To raise a quality complaint, follow our Complaints Procedure.
10. Promotional offers and trials
- Free trials: no charge applies during the trial. You will be told before the trial starts when the paid period begins and at what price. Cancelling before the end of the trial avoids any charge.
- Introductory discounts: discounted-for-a-period-then-standard-price offers renew at the standard price after the introductory period. This is disclosed at checkout and in your renewal reminder.
- Gift subscriptions and codes: non-refundable in cash but we will replace a gift code that has been lost or cannot be redeemed due to a fault on our side.
11. VAT / tax
Prices are displayed inclusive of VAT for UK and EU consumers at the applicable rate for your country of residence. If we have miscalculated VAT we will refund the overpayment in line with Section 7.
12. Your non-waivable rights
Nothing in this Refund Policy limits or excludes any non-waivable statutory rights that you have as a consumer under UK or EU law, including without limitation:
- your cooling-off rights under the CCR 2013;
- your quality rights under the CRA 2015;
- your right to seek redress from your card issuer or through the courts;
- your right to complain to Citizens Advice, to Trading Standards, or — for financial matters — to the Financial Ombudsman Service.
