18 U.S.C. § 2257 Compliance Statement

1. Overview

18 U.S.C. § 2257 and 18 U.S.C. § 2257A are United States federal statutes that impose record-keeping requirements on producers of sexually explicit visual depictions. The purpose of these statutes is to ensure that all individuals depicted in such content are adults (18 years of age or older).

Galerie Minuit is committed to preventing the exploitation of minors and fully supports the intent of these statutes.

2. Our Status Under § 2257

Galerie Minuit operates as a platform for user-generated content. We do not produce, direct, commission, or otherwise create sexually explicit content. All content on the platform is uploaded by individual registered users who act as the primary producers of their own content.

Under the regulations promulgated by the United States Department of Justice at 28 C.F.R. § 75, a distinction exists between:

  • Primary producers — individuals who actually film, photograph, or create the sexually explicit content
  • Secondary producers — entities that publish, distribute, or otherwise make available content created by primary producers

As a hosting platform for user-generated content, Galerie Minuit's record-keeping obligations are governed by the applicable provisions for secondary producers and the exemptions available to platforms that do not exercise editorial control over user submissions.

3. Age Verification Measures

Although we rely on applicable exemptions for user-generated content platforms, we take robust independent measures to verify the age of our users:

At Registration

  • All users must confirm their date of birth during account creation
  • Users must affirm they are 18 years of age or older
  • Automated age calculation verifies the user meets the minimum age requirement

Content Upload Controls

  • Only registered, age-verified users may upload photos or videos
  • All uploaded content is subject to automated moderation (NudeNet, Sightengine) and human review
  • Content flagged as potentially depicting minors is immediately removed and reported to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline, as required by 18 U.S.C. § 2258A

Profile Verification

  • Users may optionally complete profile verification to increase trust
  • Verified profiles are marked with a verification badge

4. User Responsibilities

By uploading sexually explicit content to Galerie Minuit, each user represents and warrants that:

  1. They are the primary producer of the content, or they have obtained all necessary rights and permissions from the primary producer
  2. All individuals depicted are 18 years of age or older at the time of creation
  3. They maintain all records required by 18 U.S.C. § 2257 as the primary producer, including proof of age documentation for all depicted individuals
  4. The content does not depict any illegal activity

These obligations are set forth in our Terms of Service and are a condition of using the platform.

5. Records Custodian

To the extent that Galerie Minuit is required to maintain records under 18 U.S.C. § 2257 or § 2257A, the custodian of records is:

Records are maintained by the custodian and are available for inspection during normal business hours by authorised law enforcement officials as required by law.

6. NCMEC Reporting

In compliance with 18 U.S.C. § 2258A, Galerie Minuit maintains reporting procedures with the National Center for Missing & Exploited Children (NCMEC). Any content that appears to depict a minor in a sexually explicit context is:

  1. Immediately removed from the platform
  2. Reported to NCMEC via the CyberTipline
  3. Preserved for law enforcement as required by law
  4. The uploading account is immediately and permanently terminated

We have zero tolerance for child sexual abuse material (CSAM). This is non-negotiable.

7. Cooperation with Law Enforcement

Galerie Minuit cooperates fully with law enforcement investigations related to the sexual exploitation of minors. We will respond promptly to valid legal process, including subpoenas, court orders, and search warrants.
