Digital Millennium Copyright Act (DMCA) Policy

1. Overview

Galerie Minuit ("we", "us", "our") respects the intellectual property rights of others and expects our users to do the same. This policy describes how we respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA").

We operate as a service provider under Section 512(c) of the DMCA and have implemented procedures for receiving and responding to notifications of claimed infringement.

2. Reporting Copyright Infringement

If you believe that content hosted on Galerie Minuit infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  1. Your physical or electronic signature (or that of a person authorised to act on your behalf)
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are at issue, provide a representative list
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate it (e.g., the URL of the page containing the material)
  4. Your contact information — including your name, postal address, telephone number, and email address
  5. A statement of good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf

Important: Your DMCA notice must comply with all requirements of Section 512(c)(3) of the DMCA. Incomplete or non-compliant notices may not be acted upon.

3. How We Process Takedown Notices

Upon receiving a valid DMCA takedown notice:

  1. We will promptly remove or disable access to the allegedly infringing content
  2. We will notify the user who uploaded the content that it has been removed and provide them with a copy of the takedown notice
  3. We will inform the user of their right to submit a counter-notification

4. Counter-Notification

If you believe your content was removed in error or due to misidentification, you may submit a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district in which your address is located (or, if outside the United States, any judicial district in which Galerie Minuit may be found), and that you will accept service of process from the person who filed the original DMCA notice or their agent

Send counter-notifications to the same designated agent listed in Section 2 above.

What Happens After a Counter-Notification

Upon receiving a valid counter-notification:

  1. We will promptly forward a copy to the original complainant
  2. We will inform the complainant that we will restore the removed content in 10 to 14 business days
  3. Unless the complainant notifies us that they have filed a court action seeking a restraining order against the user, we will restore the content within 14 business days of receiving the counter-notification

5. Repeat Infringer Policy

In accordance with Section 512(i) of the DMCA, Galerie Minuit maintains a policy of terminating the accounts of users who are repeat infringers of intellectual property rights.

Our policy:

  • First offence: Content removed; user notified and warned
  • Second offence: Content removed; user account suspended for 30 days
  • Third offence: User account permanently terminated

We reserve the right to terminate any account at any time if we determine, in our sole discretion, that the user is a repeat infringer, regardless of the number of prior offences.

6. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

This DMCA policy applies only to copyright infringement claims. For other types of content complaints, please use:
